Proposed MINUTES OF THE REGULAR BOARD MEETING

OF

THE CHARTER TOWNSHIP OF CHESTERFIELD

June 21, 2010

The meeting was called to order by Supervisor Lovelock at 7:00 p.m. in the Charter Township of Chesterfield Municipal Offices at 47275 Sugarbush, Chesterfield, MI 48047.

Present: Supervisor Lovelock, Clerk Uglis, Treasurer Hartman

Trustees: Bell, DeMuynck, Ficht, Printz

Also Present: Deputy Clerk Wurmlinger, Township Attorney Seibert

The Board held a moment of silence for Marine Corporal Jeffery Standfest, who was killed in action while serving in Afghanistan.

The meeting was opened with the Pledge of Allegiance led by the George Deeby Family.

The Township Board presented George Deeby and family members with a street sign and named the Historical Village entrance driveway "Deeby Historical Drive".

Mark Hurst and Pam Hill of Plante and Moran gave an overview of the 2009 Township Financial Audit.

Motion by DeMuynck, seconded by Ficht to approve the: 4A) Agenda as submitted. 4B) Approve the minutes of the Regular Board Meeting of June 7, 2010. 4C) Approve the Payment of Bills as submitted by the Finance Department. 4D) Authorized the Supervisor to sign renewal agreement with BSB Communications (telephones) for one year, July 1, 2010 through June 30, 2011, at a cost of $3,367.90. 4E) Approve Easement Encroachment Agreement for Kelly N. Richardson, 46064 Pat St. for a permit for encroachment on a public utility easement to construct an above ground pool, subject to and abiding by comments of the DPW and Building Department.

Motion by Printz, seconded by Hartman to approve introduction of an amendment to the Township Zoning Ordinance, Article XV, Section 76-611, Zoning Board of Appeals Creation and Membership and approve for first publication. (Postponed from May 17, 2010)

Motion by DeMuynck, seconded by Ficht to adopt Resolution 2010-08 approving Suburban Sewage Rates. (rates are available at the DPW office)

Nays: None MOTION CARRIED

Motion by Ficht, seconded by DeMuynck to adopt Resolution 2010-09 approving Water and Sewer Rate Increase. Water rates will increase from $2.89 to $3.18 per one thousand gallons and $3.26 per one thousand gallons for second meters. Sanitary Sewer rates will increase from $3.53 to $4.24 per thousand gallons. Clerk Uglis read Resolution 2010-09 into the record.

WHEREAS, Chesterfield Township has previously adopted Ordinance No. 68, as amended, being the Chesterfield Township Sewer and Water Rate Ordinance; and

WHEREAS, the rates charged by Chesterfield Township for water to its residents is directly related to the water commodity charges/rate charged to Chesterfield Township by the City of Detroit; and

WHEREAS, the City of Detroit has notified Chesterfield Township that the Township’s rates for water have been increased from $2.89 per 1,000 gallons to $3.18 per 1,000 gallons of water; and

WHEREAS, an additional increase for water for the second meter or sprinkler usage would increase from $2.97 per thousand gallons to $3.26 per one thousand gallons of water; and

WHEREAS, Chesterfield Township Sanitary Sewer rates will increase from $3.53 per 1,000 gallons to $4.24 per 1,000 gallons.

WHEREAS, Chesterfield Township Sanitary Sewer Ready to Serve rates will increase from a flat rate of $5.00 to $7.00 per quarter

WHEREAS, on May 3, 2010 the Chesterfield Township Board Members approved a proposal from Plante Moran that would assist the Township Board and Water Department to establish future rates and maintain operations for the Water Department; and

WHEREAS, is necessary to increase the water commodity charges/rates charged to Chesterfield Township uses to reflect the increase imposed by the City of Detroit.

NOW THEREFORE, BE IT RESOLVED BY THE TOWNSHIP BOARD OF THE CHARTER TOWNSHIP OF CHESTERFIELD, MACOMB COUNTY, MICHIGAN THAT:

The water commodity charges/rates which shall be charged by Chesterfield Township to its users shall be increased effective July 1, 2010 from the rate of $2.89 per thousand gallons of water used to $3.18 per thousand gallons of water used. Sanitary Sewer rates will be increased from $3.53 per thousand gallons to $4.24 per thousand gallons used. Sanitary Sewer Ready to Serve flat rates will increase from $5.00 to $7.00 per quarter.
